7% sales tax due on providers of digital services to consumers
Mississippi is the latest US state to impose its state sales tax on a range of digital services. This will be introduced from 1 July 2023.
This is being done be updating the definition of telecommunications services. The new in-scope services include:
- Computer Software
- Computer Software Services,
- Specified Digital Products; or
- Other Products Delivered Electronically
There is a sales tax threshold for non-residents which is $250,000 per annum. There is no transaction number threshold in Mississippi. The state introduced the economic nexus regime, imposing tax obligations on out-of-state or non-resident in September 2018. This followed the 2018 South Dakota vs Wayfair ruling.
US sales tax on digital services is now spreading with the states being initially slow.
