Missouri is to become the last of the sales taxing states to impose collections obligations on remote or foreign sellers. This will come into effect from 1 January 2023.
South Dakota vs Wayfair economic nexus sales tax trigger
45 states plus Washington DC operate a state-level sales tax, and all have now taken the opportunity to implement out-of-state taxing obligations following the 2018 South Dakota vs Wayfair Supreme Court ruling. Previously, states could only tax if the seller had some physical nexus – stocks, staff or operations in the state.
There will be a sales tax registration threshold of $100,000 per annum, after which a seller will have to register with the Department of Revenue. The threshold will imposed on facilitating marketplaces, combining their merchant and own direct sales to calculate if they have breached the limit.
Missouri has one of the most complex sales tax regimes in the use with over 2,000 taxing jurisdictions. That compares to the total number in the US of over 12,000.
