US Louisiana imposes sales tax on digital services

1 January 2025 state extends tax net to digital goods and services

Louisiana’s House Bill 8, effective 1 January 2025, expands sales tax to include previously untaxed digital goods and services. The current state-level tax is 4.45%.

Over 120 countries levy VAT on digital services.  Many US states sales tax on digital is still in early stages.

Louisiana’s definition of digital goods and services includes digital audiovisual works, audio works, books, games, and periodicals, regardless of delivery method, as well as remotely accessed software (SaaS) and digital access codes. Gift cards and certificates redeemable for non-digital items are excluded. The law defines a “sale” or “use” as the first act of viewing, accessing, downloading, or enjoying a digital product in Louisiana.

Certain exemptions apply. Digital products and software may be tax-exempt if used exclusively for commercial purposes, directly in the production of goods or services sold to customers, and subject to sales or insurance premium tax. Products created solely for a business’s internal needs and not offered for sale also qualify. Additionally, digital goods used by FDIC-insured financial institutions or licensed healthcare providers are exempt when tied to specific business purposes. Transfers are not free if bundled with taxable items, even if separately stated.

Retailers must ensure compliance by taxing products appropriately or collecting valid exemption certificates. Businesses should prepare exemption documentation for eligible items. The law also aligns use tax rules with sales tax exemptions.
